S.O. 16/C.A.2/ 1974/S.14/97- In exercise of the powers conferred by the
proviso to sub-section (1) of section 11 read with section 14 of the Code of Criminal
Procedure, 1973, and after consultation with Punjab and Haryana High Court, the
Governor of Haryana, hereby establishes two Special Courts of Judicial Magistrate
1st Class one each at Faridabad and Hisar in the State of Haryana to try and enquire
into the cases arising within jurisdiction of Haryana under the Water (Prevention
and Control of Pollution ) Act, 1974 (Act. No. 6 of 1974), the Air (Prevention
and Control of Pollution) Act, 1981 (Act No. 14 of 1981), the Environment (Protection)
Act, 1986 (Act No. 29 of 1986) the Public Liability Insurance Act, 1991 (Act No.
6 of 1991), the Indian Forest Act, 1927 (Act No. XVI of 1927), the Wild Life (Protection)
Act, 1972 (Act No. 53 of 1972). The Judicial Magistrate 1st Class of the Special
Court at Faridabad will try and enquire the offences arising within the jurisdiction
of Faridabad, Gurgaon, Mohindergarh, Rewari, Jind, Bhiwani and Rohtak Districts.
The Judicial Magistrate 1st Class at Hisar will exercise jurisdiction of the remaining
districts of Ambala, Panchkula, Kurukshetra , Kaithal, Karnal, Hisar, Sirsa, Panipat,
Sonipat and Yamuna Nagar.
The Judicial Magistrates 1st Class of these
courts shall exercise jurisdiction on the original side under these Acts and the
appeals and revisions against the judgement, decisions and orders of these courts
shall be regulated by the provisions of the Code of Criminal Procedure. The Judicial
Magistrate 1st Class of Special Court at Faridabad will be ex officio Judicial
Magistrate 1st Class of Special Court at Hisar and Judicial Magistrate 1st Class
of Special Court at Hisar will be ex officio Judicial Magistrate 1st Class of
the Special Court at Faridabad.
